The AJC is reporting that Usher will be able to keep custody of his two sons despite Tameka Raymond’s request for emergency custody.

The two were in court Friday following Monday’s accident in which five-year-old Usher Raymond V got his hand stuck in the pool drain of his father’s home. The little boy nearly drowned but was pulled from the pool by two gentlemen, one of which performed CR and revived him before the paramedics arrived. Raymond in turn requested that the boys be placed under her supervision. She also complained that Usher’s current caretaker, his aunt Rena Oden, was not sufficient enough.  “I don’t know where my kids are, who they’re with, who’s taking care of them.”

According to BET, Usher fired back that the accident “could have happened to anyone” and called his aunt a hero. He also said that upon hearing about his son’s accident, he rushed back home and got into the ambulance with him.  His Aunt Oden later testified during the court preceding that she has been caring for the boys for years and that Foster never had a problem with it.

Raymond, however, continued her case against Usher and reportedly wept throughout much of the hearing.

In the end, the judge ruled in favor of Usher remaining in control. He also said that “lack of communication between two divorced parents did not amount to danger for either one of the Raymond boys.”

Reportedly, Usher and Tameka are due back in court later on this month for another hearing over the future of the boy’s custody.
